There are three types of business texts:
- Promotional (marketing)
- Informational (product or service updates)
- Conversational (two-way communication)
Depending on the types of texts you send, there are different types of consent.
That said, if you collect express written consent from the very beginning, you may send any of these three types of business text messages — all 100% compliant (as long as you also follow the other rules).
Express written consent relies on the recipient:
- Signing a form, or
- Checking a box, or
- or actively confirming they want to receive messages, like texting you a keyword to join your subscriber list.
Think of it this way: Express written consent is getting a contact to say (or write), “Yes, I’d like to receive marketing messages from you via SMS.”
The main takeaway here is that express written consent is not implied or assumed.

Online Signup Forms
You can add a bLoyal Signup Web Snippet to your existing website, to meet the consent requirements. You can configure it capture as much or as little information as you want. The must have elements are:
- Mobile number
- Date of birth if you are in a regulated industry that requires a minimum age for purchasing
- Checkbox to opt-in to a Subscriber Group where they are expressing their consent to the text messaging terms and conditions
- Terms and conditions (see sample below)
- Automatically triggering a welcome + compliance text message (see article here)
You can create a QR Code that customers can scan to get directly to your text messaging signup page. Below is a sample text messaging signup form

POS Signup - Staff Facing
For this model, you will also need to have implemented an Online Signup Form to submit for compliance.
It is very important to have the text messaging terms and conditions printed and clearly visible close to your register. You should also train Staff on how to ask if a customer wants to sign up for text messaging while highlighting the applicable terms and conditions.
For first time signups you can use the bLoyal QuickSignup Snippet and for existing customers you can use the bLoyal QuickEdit Snippet. The must have elements are:
- Mobile number
- Date of birth if you are in a regulated industry that requires a minimum age for purchasing
- Button to opt-in to a Subscriber Group once the customer has expressed their consent to Staff that they agree to the text messaging terms and conditions
- Terms and conditions visibly posted or verbally communicated by Staff to the customer (see sample above)
- Automatically triggering a welcome + compliance text message (see article here)
POS Signup - Customer Facing
Note: This is currently y only available with Korona POS.
For this model, you will also need to have implemented an Online Signup Form to submit for compliance.
For first time signups as well as existing customers, we can configure a bLoyal POS Alert to let you know that the customer has not joined your text messaging list yet.
